By accessing or using NoCountOuts (the "Service"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service.

You must be at least 13 years old (16 in the EEA/UK) to use the Service. By using it, you represent that you meet this requirement and can form a binding contract.

You are responsible for maintaining the confidentiality of your account and for all activity under it. Notify us immediately of any unauthorized use at info@nocountouts.com.

You retain ownership of the takes, comments, and other content you post ("User Content"). You grant NoCountOuts a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content to operate and promote the Service.

You represent that you have the rights to your User Content and that it does not violate any law or third-party rights.

You agree not to:

• Post unlawful, harassing, hateful, defamatory, or infringing content.
• Impersonate any person or misrepresent your affiliation.
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
• Use automated means to scrape or abuse the Service.
• Post spam, phishing links, or malware.

We may remove content and suspend or terminate accounts that violate these Terms.

The Service, including its design, logos, and software, is owned by NoCountOuts and protected by intellectual property laws. Except for your rights in your User Content, no rights are granted to you other than to use the Service under these Terms.

If you believe content on the Service infringes your copyright, send a notice to info@nocountouts.com including the information required under 17 U.S.C. § 512(c)(3).

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, NoCountOuts and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of the Service. Our total liability for any claim will not exceed the greater of USD $50 or the amounts you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless NoCountOuts from any claims, damages, or expenses arising out of your User Content, your use of the Service, or your violation of these Terms.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or for any other reason.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.

We may update these Terms from time to time. Material changes will be communicated via the Service. Continued use after changes take effect constitutes acceptance.
